Use of website
Access to the website is granted subject to these Terms. Our products are clearly marketed for trying to conceive, pregnant and breastfeeding women, and the website is intended for adult users.
Related policies
These Terms should be read together with our Privacy Policy, Refunds and Returns Policy, Shipping & Delivery Policy, Subscription Policy and Order Cancellation Policy each of which forms part of the customer relationship and applies to your use of the website and any orders you place. Where there is any conflict between these Terms and one of those policies on a matter specifically dealt with in that policy, the relevant policy will apply.
User accounts
You may create an account on our website to manage orders and save preferences. When you create an account you agree to:
- Provide accurate, current, and complete information.
- Keep your login credentials confidential and not share them with anyone.
- Notify us promptly at hello@thismoment.co.za if you suspect unauthorised use of your account.
- Take responsibility for all activity that occurs under your account.
We may suspend or close accounts that contain false information, are used to breach these Terms, or that show signs of fraudulent activity. Where we suspend or close an account, we will give notice where reasonably possible and refund any prepaid orders that have not been dispatched.
Acceptable use
When using our website and services, you agree not to:
- Use the site for any unlawful, fraudulent, or harmful purpose.
- Transmit viruses, malware, or any harmful code.
- Attempt to gain unauthorised access to any part of the site, our servers, or related infrastructure.
- Interfere with the operation of the site, including through scraping, automated queries, or denial-of-service activity.
- Infringe our intellectual property or that of any third party.
- Harass, abuse, or harm other users, our staff, or our representatives.
- Submit content that is unlawful, defamatory, obscene, or misleading.
We may suspend or terminate access where these rules are breached.
Orders and order acceptance
When you place an order on the website, you are making an offer to purchase the products in your order. Your order is accepted by us when we send you a dispatch confirmation, at which point a contract of sale is formed between you and Moment Supplements. Until that point, we may decline or cancel your order for any reasonable cause, including (without limitation) where the product is out of stock, where we suspect fraud or breach of these Terms, where we are unable to deliver to your address, or where there has been a pricing or product description error.
Where a product is out of stock after your order is placed, we will contact you to offer a refund or, with your consent, a substitute product.
Pricing and currency
All prices on the website are displayed in South African Rand (ZAR) and are inclusive of any applicable taxes. Moment Supplements is not currently registered for VAT, and no VAT is charged on our products.
Delivery fees are calculated separately at checkout and shown before payment is confirmed.
We take reasonable care to ensure prices are accurate. In the event of a clear and obvious pricing error that a reasonable consumer would have recognised as such, we reserve the right to cancel the affected order. We will notify you of the error and the cancellation before any cancellation takes effect, and we will refund any amount you have paid.
Promotions and discount codes
From time to time we may run promotions, offer discount codes, or introduce vouchers. When we do, the specific terms applicable to that promotion (such as eligibility, expiry date, minimum spend, and exclusions) will be made available at the point of the offer. Unless stated otherwise, promotions cannot be combined and have no cash value.
Subscriptions
Where we offer a subscription option, you may sign up through the website. Subscriptions are an ongoing arrangement under which we will send you a new order every 30 days, until skipped, paused, or cancelled.
Subscriptions are processed manually by our team and are not automatic recurring debits. Before each scheduled order, we will contact you by email or WhatsApp with a secure payment link for that order, giving you the opportunity to pause, skip, or cancel before paying. We will not dispatch an order until payment has been received.
You may pause, skip, or cancel your subscription at any time by contacting us at hello@thismoment.co.za. See our Cancellation Policy for how this works in practice.
If the price of a subscription product changes, we will notify you before sending the payment link for any future order, so that you have the opportunity to cancel or amend your subscription if you do not wish to continue at the new price.
If you do not complete payment for a scheduled order within a reasonable time of receiving the payment link, that order will be skipped and we will follow up with you before your next scheduled order.
Subscription orders are not eligible for our first-purchase discount or other new-customer promotions, unless we state otherwise at the time of the offer.
Amendments
We may revise these Terms from time to time. The current version, with its "Last updated" date, will always be published on the website. Continued use of the site after changes are published constitutes acceptance of the updated Terms.
We may suspend or terminate your access to the website or services at our discretion if you violate these Terms or applicable law.
Content and intellectual property
All content on the website, including product information, images, logos, packaging designs, and formulations, is owned by or licensed to Moment Supplements (Pty) Ltd. No part of the website may be copied, reproduced, distributed, or otherwise used without our prior written consent.
By submitting reviews, comments, photos, or other feedback to us ("User Content"), you grant Moment Supplements a worldwide, perpetual, irrevocable, royalty-free, sub-licensable and transferable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display that User Content in connection with our business, including in marketing, on our website, on social media, and in other communications. You confirm that the User Content is yours to share, does not breach any third party's rights, and does not contain confidential information you do not wish to disclose.
You may request that we remove User Content you have submitted by contacting us at hello@thismoment.co.za. On receipt of a reasonable request, we will remove the relevant content from materials within our control within a reasonable period. We cannot guarantee removal from materials that have already been published elsewhere (including in printed materials, on third-party platforms, or copies shared by others) or that are no longer within our control. Nothing in this clause is intended to waive any moral rights you hold under South African law to the extent those rights cannot lawfully be waived.
Health and medical disclaimer
The information on this website is provided for general informational purposes only and is not a substitute for medical advice, diagnosis, or treatment from a qualified healthcare professional.
Our products are sold as health supplements. In line with current SAHPRA requirements for unregistered complementary medicines, the following statement applies:"This unregistered medicine has not been evaluated by the SAHPRA for its quality, safety or intended use."
Our products are not medicines and are not intended for use in the diagnosis, treatment, cure, or prevention of any condition. You should consult a qualified healthcare professional before using our products, particularly if you are pregnant, breastfeeding, on chronic medication, or living with an existing health condition.
The same disclaimers apply to all of our communication channels, including WhatsApp, email, phone, live chat on the website, and chatbots. Information shared through these channels is general in nature and is not medical advice.
Liability
The website is provided on an "as is" basis. We do not warrant that the website will be error-free, continuously available, or completely accurate, and we are not responsible for content on third-party sites linked from ours.
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under South African law, including liability under section 61 of the Consumer Protection Act for harm caused by unsafe or defective goods, or liability for gross negligence or wilful misconduct. For the avoidance of doubt, nothing in these Terms limits our product liability for harm caused by unsafe or defective goods.
Subject to the paragraph above, and to the maximum extent permitted by law, Moment Supplements, its directors, employees, and representatives will not be liable for any loss that is not a direct and reasonably foreseeable consequence of our breach, including loss of profits, loss of opportunity, or pure economic loss, arising from use of the website or reliance on information published on it or shared through our communication channels.

Links to third-party websites are provided for convenience only. We do not endorse and are not responsible for the content, products, or practices of any third-party site.
Force majeure
We will not be in breach of these Terms or otherwise liable for delays or failures in performance caused by events beyond our reasonable control. These include, without limitation, acts of God, natural disasters, fire, flood, severe weather, pandemics or public health emergencies, war, civil unrest, acts of government or regulators, load-shedding or extended power failures, telecommunications or internet outages, courier and logistics failures, port or border disruptions, and labour disputes. Where such an event occurs, we will take reasonable steps to mitigate its effects and to keep customers informed.
Complaints
If you have a complaint about our products, service, or any aspect of your dealings with us, please contact us at hello@thismoment.co.za in the first instance, and we will respond within two (2) business days. We take complaints seriously and will work with you in good faith to resolve them. Nothing in this clause limits your right to refer a complaint to the National Consumer Commission, the Information Regulator (in respect of personal information matters), or any other competent forum.
Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. The parties submit to the exclusive jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town, in respect of any dispute arising out of or in connection with these Terms. Nothing in this clause limits any rights consumers may have under the Consumer Protection Act or other applicable law to refer disputes to the National Consumer Commission, the Magistrate's Court, or another competent forum.
