Affiliate programme terms
Joining the programme
These Affiliate Programme Terms ("Terms") apply to anyone who takes part in the Moment Affiliate Programme ("Programme"). They should be read together with our Terms of Service, Privacy Policy, and other policies, which continue to apply to your use of our website. By taking part in the Programme, you agree to these Terms.
Joining the Programme is by application, not automatic enrolment. We review each application and may approve or decline it at our sole discretion. You won't have any claim against us if your application is declined.
To apply, you must be 18 years or older and have the legal capacity to enter into this agreement. You must be free to promote Moment's products without restriction, and you confirm that doing so will not breach any professional, regulatory, or membership obligation that applies to you (for example, restrictions imposed by a professional body such as the HPCSA).
How the programme works
Once approved, we'll give you a unique referral code to share with your community. We don't use an affiliate platform; the Programme is run manually by our team.
We may remove you from the Programme at any time, at our discretion, including where we believe you've breached these Terms. We may also stop the Programme altogether at any time. Where we suspect fraud, abuse, or other foul play in connection with your participation, we reserve the right to take legal action.
Qualifying transactions
A Qualifying Transaction is a completed, paid order for our Prenatal Core or Prenatal Core & Iron Combo products, where the customer used your referral code at checkout, and the order is not cancelled, refunded, or charged back. Orders for other products do not qualify for commission.
The following also do not qualify for commission: purchases you make for yourself or your household, orders placed using unauthorised or stacked discounts, and orders we reasonably believe involve fraudulent or abusive use of your code.
Commission structure
Customers who use your referral code receive a 20% discount on their order.
You earn R200 when a customer you've referred makes their first Qualifying Transaction, and a further R200 when that same customer makes their second Qualifying Transaction.
We may change the commission structure or discount level from time to time. We'll let you know before any change takes effect for you.
Content and conduct
When promoting Moment, you agree to:
- Clearly disclose that you're a paid affiliate or partner (for example, "paid partnership" or "affiliate") wherever you share your code or talk about Moment.
- Not make any health, medical, or therapeutic claims about our products, and not go beyond the product claims we've approved.
- Share only your genuine experience, and not post anything false, misleading, or that could bring Moment into disrepute.
- Use only the assets and copy we've supplied or approved, and remove any content at our reasonable request.
We may review your content at any time to check it meets these standards.
Payment
We pay commission in South African Rand, within 10 business days of us receiving payment from the customer for the relevant order.
We'll only ask you for your bank details once a customer has used your referral code, and only for the purpose of paying your commission.
You're responsible for declaring and paying any tax owed on commission you earn. We don't withhold tax on your behalf unless required by law.
We may withhold or reverse a commission payment where the underlying order turns out not to be a Qualifying Transaction, or where you've breached these Terms.
Independent contractor
You take part in the Programme as an independent contractor. Nothing in these Terms creates an employment, partnership, agency, or joint venture relationship between you and Moment. You have no authority to make commitments on our behalf, and you're responsible for your own costs, tax affairs, and any registrations needed to take part in the Programme.
Content licence
You grant us a non-exclusive, royalty-free licence to repost and share content you create about Moment (including your name, image, and social handle) on our own channels, for as long as you're an active affiliate and for 12 months afterwards. We won't use your content in paid advertising unless we've separately agreed this with you in writing.
Confidentiality
Any non-public information we share with you, including commission rates and marketing plans, must be kept confidential and used only for your participation in the Programme. This continues to apply after the Programme relationship ends.
Ending the relationship
Either of us may end your participation in the Programme at any time, on reasonable notice, or immediately where we reasonably believe you've breached these Terms. Once it ends, you must stop using your referral code, stop presenting yourself as a Moment affiliate, and remove related content where we reasonably ask you to. We'll still pay out any commission properly earned on Qualifying Transactions completed before the relationship ended.
Liability
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under South African law, including liability under section 61 of the Consumer Protection Act for harm caused by unsafe or defective goods.
Subject to the paragraph above, and to the maximum extent permitted by law, our total liability to you under these Terms is limited to the commission earned and payable to you, and we won't be liable for indirect losses such as loss of profits or opportunity.
You agree to cover any claim, loss, or cost we reasonably incur as a result of your content, your conduct, or your breach of these Terms.
Amendments
We may revise these Terms from time to time. The current version, with its "Last updated" date, will always be available online. Continuing to take part in the Programme after changes are shared with you constitutes acceptance of the updated Terms.
Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. The parties submit to the exclusive jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town, in respect of any dispute arising out of or in connection with these Terms.
